1. Общие положения и область действия
1.1 These Terms constitute the complete agreement between you and Kvmjet ("we" / "the Platform") regarding your use of Mac Cloud computing resources and related technical services ("the Service"). Plan descriptions, pricing rules, announcements, and order confirmations, once confirmed or paid for, are deemed supplementary parts of these Terms.
1.2 You confirm that you have full legal capacity or have obtained lawful authorization. If you are acting on behalf of an organization, you warrant that you have authority to bind that organization and accept joint and several liability.
1.3 We reserve the right, to the extent permitted by law, to accept or refuse registrations, orders, and high-risk industry applicants. For accepted orders, we may suspend or cancel provisioning in cases of suspected fraud, non-payment, violations, or force majeure.
1.4 The Privacy Policy forms part of these Terms. In the event of conflict, the Privacy Policy governs personal data processing; these Terms govern fees, service availability, liability limits, and dispute resolution.

2.1 The Service is provided "as is" and "as available". Specifications and performance descriptions on product pages are for reference only and do not constitute guarantees of a specific experience or uninterrupted availability for any particular use case, unless a separate written SLA is issued for your order.
2.2 An order submitted through the pricing page constitutes an offer; we accept upon confirming receipt of payment or sending an order confirmation notice. We may reject orders due to obvious pricing errors, insufficient inventory, or compliance reasons, and will handle any collected payment via the original channel or as announced.
2.3 Where "place order before login" is supported, you must complete account binding and verification (if applicable) within the specified period; otherwise we reserve the right to decline provisioning or terminate resources.
2.4 After successful payment, resource provisioning depends on inventory, region, risk-control review, and information you provide. Delays caused by your failure to cooperate are your responsibility.

3.1 Prices are as displayed on the page at the time you place and complete payment for your order. We may adjust public pricing; adjustments have no retroactive effect on active, unexpired orders unless required by law or separately notified.
3.2 Daily billing is generally a one-time prepayment with no auto-renewal. Weekly/monthly/quarterly periodic billing auto-charges the next period before the current one expires, unless you explicitly disable auto-renewal. Non-payment constitutes a material breach, and we may immediately suspend or reclaim resources.
3.3 You must pay through the platform's designated payment channels. Chargebacks, chargeback abuse, or exploiting payment vulnerabilities may result in a permanent transaction ban and recovery of outstanding amounts.

4.1 Your account and all access credentials (passwords, tokens, API keys) are for your exclusive use at your own risk. We are not liable for losses resulting from your disclosure, sharing of credentials, or failure to exercise reasonable care.
4.2 To fulfill the contract, conduct security audits, and provide technical support, we may implement reasonable and necessary monitoring and access controls at the console and metadata level.
4.3 Where we have reasonable grounds to suspect unauthorized access, fraud, or attack activity, we may restrict logins, freeze orders, or suspend instances until the risk is resolved.
4.4 Procedures such as password resets are subject to real-time in-platform prompts; we may upgrade verification methods to protect account security.
5. Допустимое использование и запрещённые действия
5.1 You warrant that your use of the Service complies with all applicable laws and regulations. Prohibited activities include but are not limited to:
- Any activity that is unlawful in any relevant jurisdiction or may expose the Platform to administrative or criminal liability;
- Infringement of others' intellectual property, privacy, or reputation, or dissemination of illegal content;
- Unauthorized intrusion, scanning, mining, spam, or attacks against third parties;
- Abusing promotions or payment systems through false identities, cash-out schemes, money laundering, or price manipulation.
5.2 Upon confirmed or reasonably suspected violations, we may issue warnings, apply rate limits, shut down instances, terminate service, permanently ban accounts, and/or report to competent authorities.
6. Данные, сеть и IP
6.1 You are solely responsible for the legality, licensing, and backup of data and applications within your instance. We are not liable for data loss or business interruption except where directly and foreseeably caused by our gross negligence or willful misconduct.
6.2 Public network quality, upstream carrier routing, and third-party services are beyond our control; absent a written SLA, we make no guarantees regarding sustained latency or availability for specific applications.
6.3 Representations regarding IP, bandwidth, and "dedicated" resources are as stated on the product page and in your order. If your IP is blocked due to your unlawful or abusive conduct, you bear the consequences.
7. Изменения, перерывы и прекращение сервиса
7.1 For technical upgrades, capacity adjustments, compliance remediation, or business strategy, we may modify, replace, or discontinue certain features or regional availability, with reasonable advance notice via website, console, or email.
7.2 You may cancel according to our rules; already-provisioned and consumed periods, penalty fees, and orders terminated early due to your actions are non-refundable unless required by law or committed to in writing by us.
7.3 Where we terminate service due to your non-payment or violations, we reserve the right to dispose of resources and billing accounts, and to recover outstanding amounts and reasonable enforcement costs from you.

8.1 Refunds are subject to our published rules, special order terms, and written responses from tickets/support. Customized, promotional, explicitly non-refundable orders, or those involving suspected abuse/fraud may be fully or partially denied refunds.
8.2 To the maximum extent permitted by law, our total cumulative liability to you under these Terms for any dispute shall not exceed the net amount you actually paid us for the disputed resources in the twelve (12) months preceding the dispute.
8.3 We are exempt from liability, to the extent permitted by applicable law, for performance failures caused by force majeure, your actions or those of third parties, government actions, or upstream power/network outages.
9. Изменения условий и уведомления
9.1 We may amend these Terms at any time; amendments take effect upon publication on the website, or on a future date specified in the notice. Where an amendment materially increases your financial burden or significantly restricts your rights, we will endeavor to provide reasonable advance notice.
9.2 Your continued use of the Service or renewal payment constitutes acceptance of the amended Terms.
10. Применимое право и разрешение споров
10.1 The formation, interpretation, and performance of these Terms are governed by the laws of the jurisdiction where Kvmjet's operating entity is incorporated, except where mandatory consumer protection provisions apply.
10.2 Disputes shall first be resolved through negotiation; if negotiation fails, they shall be submitted to the competent court at the place of incorporation of the operating entity.
