Updated 2026-04-09 Website, console, and related products Terms of Service

1. Who We Are & Scope

1.1 This Policy applies to personal information processing arising from your access to the Kvmjet website, account registration/login, placing orders, use of the console or instances, and communications with us.

1.2 Where a specific pop-up, order confirmation, or feature description for a particular transaction or feature conflicts with this Policy, the specific text in effect for that transaction or feature takes precedence. In interpreting and applying policy terms, we reserve the right to make reasonable interpretations for compliance and contractual purposes without violating mandatory law.

1.3 This Policy is used in conjunction with theTerms of Service; matters relating to service delivery boundaries, suspension/termination, and liability limitations are governed by the Terms of Service.

2. Information We Collect

2.1 Information you actively provide: contact details, identity verification materials, and communications submitted during registration/login, ordering, invoicing, tickets, and support interactions. You warrant the accuracy of information provided; order failures or losses resulting from false or incomplete information are your responsibility.

2.2 Information automatically generated when using the Service: access and service logs, device and browser information, approximate region based on IP, operation records, technical metadata related to resources (e.g., instance ID, usage, status), and network/connection summary information necessary for contract performance, anti-fraud, and security auditing.

2.3 Payment information: order amounts, payment channel receipts, and reconciliation results are processed jointly by us and licensed payment institutions; sensitive payment credentials such as full card numbers are generally collected directly by the payment institution. For disputed amounts or chargebacks, we may retain transaction records and identity verification results within the scope necessary for communications with payment institutions and card issuers.

2.4 You must not submit passwords, private keys, unredacted personal information of others, or other unnecessarily sensitive content via tickets, chat, or similar channels; we bear no responsibility for leaks or compliance risks arising therefrom.

3. How We Use Information

3.1 To the extent permitted by applicable law, we may use information for the following purposes (including where necessary for contract formation and performance, and legitimate interest scenarios, limited to what is necessary to achieve the purpose):

  • Account provisioning, order fulfillment, billing, reconciliation, invoicing, and after-sales services;
  • Technical support, ticket handling, and contacting you regarding service matters;
  • Identity verification, account security, anti-fraud, abuse detection, debt collection, and enforcement of the Terms of Service;
  • System operations, capacity and quality analysis, product improvement, and internal statistics (data may be de-identified or aggregated);
  • Compliance with laws and regulations, cooperation with lawful requests from regulatory or judicial authorities, and processing necessary to protect significant legitimate interests such as personal safety and property;
  • Sending service notices, security and compliance alerts with your consent or as permitted by law; marketing communications will offer an opt-out option where possible, but this does not affect delivery of necessary contract-related notices.

3.2 When we reasonably determine that continuing to process as originally intended conflicts with this Policy or applicable law, we may adjust the scope of processing after stopping use, anonymizing, or providing separate notice (as appropriate). To assert rights, handle disputes, or respond to regulatory investigations, we may retain and use relevant information beyond the original everyday purpose for the necessary period.

4. Cookies & Similar Technologies

4.1 We may use cookies, local storage, or similar technologies to maintain sessions, save language/interface preferences, perform necessary risk control and session security checks, and conduct access analytics and experience improvement.

4.2 You may manage cookies in your browser; refusing or deleting technologies necessary to operate the Service may prevent login, order completion, or certain features — this does not constitute our breach of contract, nor does it automatically create a refund obligation (subject to theTerms of Serviceand order terms).

5. Sharing, Transfer & Disclosure

5.1 Sharing: We may provide information necessary for contract performance, anti-fraud, and compliance to processors such as payment institutions, cloud computing and communication providers, and risk control and security service providers, and require them to assume confidentiality and security obligations via contract. Where required by law or regulation, or by lawful requests from judicial or administrative authorities, we may disclose information to authorized parties within the legally required scope and may do so without prior notice to you (unless disclosure itself is prohibited by law).

5.2 Transfer: In the event of a merger, split, asset restructuring, or business sale resulting in personal information transfer, to the extent permitted by law, the new holder may assume the information processing relationship within the scope necessary to continue providing similar services or performing existing contracts. We will endeavor to require transferees to be bound by protection standards no less stringent than this Policy and will notify significant changes via announcements or in-platform notices as required by law.

5.3 Disclosure: Except as required by law or necessary to protect significant legitimate interests of the platform, other users, or the public, we will not publicly disclose your personal information. To stop obvious unlawful or abusive use, we may provide a necessary summary of relevant materials to injured parties or competent authorities to the extent permitted by law.

6. Cross-Border Transfers & Storage Locations

6.1 Your information may be stored in infrastructure operated by us or our partners in different jurisdictions. Given the nature of the cloud host business, by placing orders and using the Service you understand and agree that data may be transferred and stored overseas or across regions for contract purposes (where required by applicable law, we will obtain separate consent or take alternative measures).

6.2 The data center region may affect the technical data storage location, subject to theplan details, order page, and order confirmation; we cannot guarantee a permanently fixed legal jurisdiction unrelated to public network routing for individual customers.

7. Retention Periods

7.1 We retain information for the period necessary to fulfill the purposes described in this Policy. We may also retain necessary records for longer statutory or industry-standard periods for purposes including accounting and tax, anti-money laundering and payment disputes, debt collection, cooperation with administrative enforcement, and asserting or defending against claims under the service contract — and cancellation of your account does not automatically shorten retention to less than the statutory period (unless legally required to delete).

7.2 After the retention period, we will delete, anonymize, or archive in a non-individually-identifiable form; where law or regulation requires continued retention, the statutory requirement takes precedence.

8. Your Rights

8.1 To the extent permitted by applicable law and without conflicting with our legitimate business interests, the lawful rights of third parties, or legal obligations, you may request access, copy, correction, supplementation, deletion, withdrawal of consent (if applicable), and restriction of processing of your personal information, and may submit complaints to us.

8.2 You may submit requests via theContact Usor a console ticket. We reserve the right to respond within a reasonable period after verifying identity and assessing the legality and necessity of the request. We may lawfully refuse malicious, manifestly repetitive, or technically excessive requests, or (where permitted by applicable law and stated in advance) fulfill them upon payment of a reasonable cost. For information directly related to ongoing fraud investigations, litigation, debt collection, or administrative proceedings, we may defer response until the relevant proceedings conclude or disclosure is legally permitted.

9. Protection of Minors

This Service is intended for users with full legal capacity. If you are a minor, you must read this Policy and theTerms of Serviceunder the accompaniment of a guardian and may only use the Service with guardian consent. If we have reasonable grounds to believe an account should be managed by a guardian without proper authorization, or that there is a risk to the interests of a minor, we may suspend or terminate the relevant account and service and process related information by deletion or anonymization in accordance with applicable law.

10. Information Security

We implement reasonable management and technical measures proportionate to our business scale to reduce the risk of information leakage, tampering, and loss. Please understand that no internet system can guarantee absolute security; losses resulting from causes beyond our control — such as device infection, weak passwords, sharing credentials with others, force majeure, or third-party attacks — are not our responsibility (unless mandatory law provides otherwise, and absent our willful misconduct or gross negligence). When a security incident occurs that may affect your interests, we will notify you and take action in a reasonable manner as required by applicable law, and may cooperate with competent authorities within the scope that does not violate confidentiality obligations and investigative needs.

11. Policy Updates

We may revise this Policy from time to time. Updated versions take effect upon publication on the website (or as otherwise specified by statutory public notice period or separate notice via pop-up/email). Without reducing any mandatory rights you have lawfully acquired, continued use of the Service after the effective date constitutes acceptance of the revision; if you disagree, you should stop using the Service and cancel/settle, and we may handle the account and data in accordance with theTerms of Serviceto the extent permitted by law. Disputes arising from your failure to read announcements in a timely manner do not affect the validity of revisions for users who continue to use the Service.

12. Contact Us

For inquiries or rights requests related to this Policy, please submit via theContact UsorHelp Centerpublicly listed channels. We may prioritize written responses via email or console ticket; requests where identity cannot be verified or that conflict with ongoing enforcement/litigation proceedings may be deferred.
